ABC wins UDRP case

American Broadcasting Companies (ABC) has announced that it has won a complaint under ICANN’s Uniform Domain Name Dispute Resolution Policy (UDRP) against Rosa Edwards, the registrant of the goodmorningamerica.com domain name.
Complainant ABC alleged that the domain name at issue was identical to its registered Good Morning America trademark. However, Respondent Ms Edwards argued that the domain name was comprised of a simple greeting and that ABC’s trademark registration of the phrase for a morning television program did not give it exclusive rights to the phrase. She also asserted that ABC abandoned the right to use the phrasing in a domain name by failing to take action for eight years.
However, the National Arbitration Forum (NAF) Panel determined that the company’s registration with the United States Patent and Trademark Office was sufficient to establish its rights to the Good Morning America mark for Internet purposes.
Having established all elements required under the ICANN Policy, the NAF Panel concluded that the goodmorningamerica.com domain name be transferred from Respondent to Complainant.
